In order for a chemical to be recommended for listing in Annex III of the Convention, two notifications of final regulatory action for the chemical from two different PIC regions must meet the Annex I and Annex II requirements of the Convention. When the Chemical Review Committee concludes that a notification of final regulatory action met the Annex II criteria, it adopts a rationale as to how the criteria have been met. Where the Committee has determined that only one of the notifications of final regulatory actions meets the criteria of Annex II of the Convention, the Committee is not able to recommend listing the chemical in Annex III.
