Opening of the meeting

1. The eighth meeting of the Conference of the Parties to the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade will be held at the Geneva International Conference Centre, 17 rue de Varembé, Geneva, from 24 April to 5 May 2017, back-to-back with the thirteenth meeting of the Conference of the Parties to the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal and the eighth meeting of the Conference of the Parties to the Stockholm Convention on Persistent Organic Pollutants. The meetings will feature joint sessions on joint issues. The meetings will be opened at 10 a.m. on Monday, 24 April 2017, by the three presidents of the conferences of the Parties.

At its first meeting, by decision RC-1/1, the Conference of the Parties to the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade adopted its rules of procedure, as contained in the annex to that decision, with the exception of the second sentence of paragraph 1 of rule 45, which it agreed to maintain in square brackets to indicate that it had not been agreed and was of no effect.

At its seventh meeting, in decision RC-7/1, on a proposal for activities to increase notifications of final regulatory action, the Conference of the Parties to the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade, among other things, urged Parties to exchange information in accordance with the provisions of the Convention by submitting notifications of final regulatory action for banned or severely restricted chemicals.

1. Paragraph 2 of Article 11 of the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade sets out the obligations and conditions relating to the export of chemicals listed in Annex III to the Convention in exceptional circumstances when an importing Party has failed to transmit an import response or has transmitted an interim response that does not contain an interim decision.

Subsequently, at its second meeting, the Committee, in accordance with Article 7 of the Rotterdam Convention, agreed on the text of a draft decision guidance document for the chemical (UNEP/FAO/RC/CRC.2/20, para. 106 and annex I) and decided to forward it to the Conference of the Parties for its consideration. Pursuant to Article 5 of the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade, the Chemical Review Committee at its tenth meeting reviewed notifications of final regulatory action for short-chain chlorinated paraffins from Norway and Canada, along with the supporting documentation referenced therein. Taking into account each of the specific criteria set out in Annex II to the Convention, the Committee concluded that the criteria of that Annex had been met. Accordingly, the Committee agreed by its decision CRC-10/4 to recommend to the Conference of the Parties that short-chain chlorinated paraffins1 be listed in Annex III to the Convention as industrial chemicals and proceeded to prepare a draft decision guidance document.

1. At its fourth meeting, by its decision RC-4/5, the Conference of the Parties to the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade agreed to list tributyltin compounds in Annex III to the Convention under the pesticide category and adopted the related decision guidance document (UNEP/FAO/RC/COP.4/10, annex V), based on two notifications of final regulatory action for tributyltin compounds under the pesticides category from two prior informed consent regions (Europe: European Union; North America: Canada) that the Chemical Review Committee had found met all the criteria of Annex II to the Convention.

Pursuant to Article 5 of the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade, the Chemical Review Committee at its eleventh meeting reviewed notifications of final regulatory action for carbofuran as a pesticide from the European Union, Canada and seven African parties, Cabo Verde, Chad, the Gambia, Mauritania, the Niger, Senegal and Togo, along with the supporting documentation referenced therein. The seven African Parties were all members of the Sahelian Pesticides Committee, and their notifications all related to a single final regulatory action applicable to the Sahelian region. Taking into account each of the specific criteria set out in Annex II to the Convention, the Committee concluded that the criteria of that Annex had been met. Accordingly, the Committee agreed by its decision CRC-11/3 to recommend to the Conference of the Parties that carbofuran be listed in Annex III to the Convention as a pesticide and proceeded to prepare a draft decision guidance document.

As referred to in document UNEP/FAO/RC/COP.8/16, on 11 October 2016 the Secretariat received proposals to amend two provisions of the Rotterdam Convention: Article 16 on technical assistance and Article 22 on adoption and amendment of annexes. The proposals, submitted by Botswana, Cameroon, Ghana, Kenya, Lesotho, Malawi, Mozambique, Namibia, Nigeria, South Africa, Swaziland, Tanzania, Zambia and Zimbabwe in the case of Article 16, and by Botswana, Cameroon, Ghana, Kenya, Lesotho, Malawi, Mozambique, Namibia, Nigeria, Swaziland, Tanzania and Zambia in the case of Article 22, are set out in annex I to the present note. In its decision BC-12/8, on national legislation, notifications, enforcement of the Convention and efforts to combat illegal traffic, the Conference of the Parties to the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal at its twelfth meeting took note of the analysis of possible synergies in preventing and combating illegal traffic and trade in hazardous chemicals and wastes, building on lessons learned under the Basel Convention, and requested the Secretariat to transmit the analysis to the conferences of the Parties to the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade and the Stockholm Convention on Persistent Organic Pollutants. The analysis had been prepared by the Secretariat thanks to generous financial support provided by the Government of Japan. In the decision, the Conference of the Parties also requested the Secretariat to prepare, for the consideration of the Conference of the Parties at its thirteenth meeting, recommendations on possible synergies between the Basel, Rotterdam and Stockholm conventions in preventing and combating illegal traffic and trade.

By their decisions BC-12/22, RC-7/12 and SC-7/30 entitled “From science to action”, the conferences of the Parties to the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal, the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade and the Stockholm Convention on Persistent Organic Pollutants recognized the importance of the science-policy interface for the effectiveness of the conventions and the need for greater access to scientific understanding in developing countries to enhance informed decision-making on the implementation of the conventions.
