Opening of the meeting
1. The ninth meeting of the Chemical Review Committee will be held at the headquarters of the Food and Agriculture Organization of the United Nations, Viale delle Terme di Caracalla, Rome, from 22 to 25 October 2013. The meeting will be opened at 10 a.m. on Tuesday, 22 October 2013.

I. Introduction
1. In its decision RC-2/2, the Conference of the Parties to the Rotterdam Convention adopted the process for the preparation of draft decision guidance documents. According to the process, task groups are to be established for each chemical and severely hazardous pesticide formulation to be considered by the Chemical Review Committee. Furthermore, to promote efficiency in its work, the Committee agreed on a procedure for dealing with notifications of final regulatory action to ban or severely restrict chemicals. For ease of reference, the procedure is set out in a compilation of working procedures and policy guidance for the Chemical Review Committee in document UNEP/FAO/RC/CRC.9/INF/6.

I. Introduction
1. Under Article 6 of the Rotterdam Convention on the Prior Informed Consent Procedure for
Certain Hazardous Chemicals and Pesticides in International Trade, any party that is a developing
country or country with an economy in transition and that is experiencing problems caused by a
severely hazardous pesticide formulation under conditions of use in its territory may propose to the
Secretariat the listing of the formulation in Annex III to the Convention. The proposal shall contain the
information required by part 1 of Annex IV to the Convention.

1. As indicated in document UNEP/FAO/RC/CRC.9/4, in February 2012 the Secretariat received
a proposal from Chad to list fenthion 640 ULV in Annex III to the Rotterdam Convention on the Prior
Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade.
In accordance with paragraph 3 of Article 6 of the Convention, the Secretariat requested parties and
observers to review the formulation identified in the proposal and to submit any information set out in
part 2 of Annex IV to the Convention.

The notification of final regulatory action for cyhexatin provided by Canada was considered by the Chemical Review Committee at its second meeting. The annex to the present note sets out the rationale for the Committee’s conclusion that the notification met the criteria set forth in annexes I and II to the Rotterdam Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade. The rationale was originally made available in annex II to the report of the Committee’s second meeting (UNEP/FAO/RC/CRC.2/20) and is reproduced in the annex to the present note without formal editing.

1. At its seventh meeting, the Chemical Review Committee reviewed two notifications of final
regulatory action related to pentachlorobenzene from two prior informed consent (PIC) regions: Asia
(Japan) and North America (Canada). The Committee concluded that the notification from Canada met
the criteria set forth in Annex II to the Convention and adopted a rationale, while the notification from
Japan did not meet the criteria in paragraph (b) of Annex II. The details of those conclusions may be
found in the report of the seventh meeting.1
